According to a comprehensive analysis by the National Transportation Safety Board (NTSB), Bernath was operating a Van’s Aircraft RV-12 and flying outside safe speed parameters. The report highlights that he was within the yellow caution range on the airspeed indicator and exceeded the aircraft’s maximum structural cruising speed. This excessive speed likely contributed to a catastrophic structural failure of the plane’s left wing just moments before the crash, which occurred in a wooded area near a gated community while he was en route to Everglades Airport.

An autopsy revealed a concerning mix of psychoactive medications in Bernath’s system, specifically Citalopram, Mirtazapine, and Trazodone—all antidepressants known to impair cognitive function and motor skills. These medications carry warnings regarding their effects on tasks requiring focused judgment, such as piloting an aircraft.

Adding to the complexity of the situation, Bernath had recently been released from a Virginia jail after a lengthy incarceration. The NTSB report also indicated significant underlying health issues, including advanced coronary artery disease, which could have led to a sudden cardiac event during the flight.

The NTSB concluded that Bernath’s physical and mental health issues likely hindered his ability to operate the aircraft safely.

Despite the inability to identify a singular cause for the crash, the NTSB found no evidence of mechanical failure or adverse weather conditions, leading to the conclusion that Bernath’s psychological and physiological conditions likely influenced the incident. Furthermore, the failure to report any medical issues or prescribed medications to the FAA constituted a violation of regulations—a factor that may have prevented him from obtaining a medical certificate.

Bernath was recently released from a Virginia jail just days before the accident, according to Wong. During her testimony to the NTSB, she revealed that Bernath had spent several months incarcerated for violating a restraining order related to a “stolen valor” allegation against him.

In 1995, he faced a major setback when he was denied permission to practice law in California due to nonpayment of child support to his first wife.

Following his reinstatement, Bernath relocated to Oregon and sought to gain admission to the Oregon State Bar. Although he successfully passed the Bar Exam, his hopes were dashed when the Bar Association rejected his application.
